By this application, the appellant is seeking condonation of delay in filing undertaking in terms of the order dated 04.10.2019 passed by this Court.

An undertaking has been already filed but it could not be filed within the stipulated period of time. But, a perusal of the undertaking would show that it is not exactly in terms of the directions given by this Court in the order dated 04.10.2019.

In this situation, the learned counsel for the appellant submits that a fresh undertaking would be placed on record before this Court by 22.10.2019. 4.

Hence, this application is disposed of by directing the appellant to file a fresh undertaking in terms of the order dated 04.10.2019 before this Court on or before 22.10.2019.

It is further made clear that no further time shall be granted for filing undertaking. Needless to say that if an undertaking is not filed before this Court on or before 22.10.2019, the direction issued by this Court granting time of eight weeks to the appellant to vacate the suit premises, shall cease to operate.
