IN THE HIGH COURT OF JUDICATURE AT BOMBAY

NAGPUR BENCH, NAGPUR WRIT PETITION NO. 8240/2022 (SURENDRA V. AZAD DAYASHANKAR SINGH VERSUS THE CENTRAL PROVIDENT FUND COMMISSIONER, NEW DELHI) Office Notes, Office Memoranda of Coram, appearances, Court's orders of directions Court's or Judge's order and Registrar's orders.

Shri J.D. Bastian, counsel for the petitioner. CORAM : A. S. CHANDURKAR AND ANIL L. PANSARE , JJ.

D ATE : DECEMBER , 202 2 .

The petitioner seeks to challenge the initiation of departmental proceedings against him by urging that he is innocent and the said proceedings are unwarranted. In the alternative it is prayed that the departmental proceedings be kept in abeyance till the completion of criminal prosecution since the petitioner would be required to disclose his defence in the departmental proceedings.

We find that the petitioner has not yet made any request in the departmental proceedings to stay the same on account of pendency of the criminal trial. With liberty to the petitioner to make such request in the departmental proceedings and with further liberty to take necessary steps if that request is not accepted, the writ petition is disposed of. No costs. (ANIL L. PANSARE, J.) (A. S. CHANDURKAR, J.) APTE byROHIT DATTATRAYA APTE
