The order impugned in the writ petition is on an application filed by the plaintiff for appointing Court Commissioner. That application was moved shortly after filing of the suit. The said application came to be rejected by the trial court observing that the temporary injunction application was pending.

After arguing the writ petition for some time, the learned Counsel for the petitioner seeks permission to withdraw the same with liberty to move fresh application in case contingency for the same arises.

Hence, the writ petition is permitted to be withdrawn. If such contingency arises and an application is moved, same shall be considered on its own merits without being influenced by the earlier order.

The writ petition is disposed of as withdrawn. JUDGE *sandesh
