The applicant has sought pre-arrest bail in the crime registered against him for the offences punishable under Sections 353 and 323 of the Indian Penal Code and Section 3(1)(x), 3(2)(v)(a), 3(1)(r) and 3(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. This Court has passed an order on 1st November, 2016 granting interim protection to the applicant. The learned A.P.P. has submitted that the chargesehet is ready and may be filed during this week.
However, after hearing the learned advocate for the applicant and going through the application filed by the applicant, I find that the applicant has not made any statement about the antecedents. As in my view, the involvement of the applicant seeking pre-arrest bail in any other crime/ offence is relevant consideration and it is lacking in the present application, the application is dismissed with liberty to the applicant to file fresh application, if so advised.
