The preliminary objection by the respondent is that this Court lacks jurisdiction to entertain, try and decide this Writ Petition, keeping in view the controversy involved and the party respondents in this petition.

In view of the aforesaid preliminary objection, Shri. Palshikar, the learned counsel appearing for the petitioner, after taking instructions, seeks permission to withdraw this petition. The permission is granted with liberty to file the petition before the appropriate bench of this Court at Mumbai.
