The applicant filed an appeal before this Court challenging judgment and award passed by learned Member, Motor Accident Claims Tribunal, Nagpur. The said appeal was barred by limitation. Therefore, an application for condonation of delay was filed. The appeal was on stamp. However, since steps were not taken by the applicant, the said application for condonation of delay was dismissed. Therefore, these two applications for condonation of delay and restoration of Civil Application No.188/2017 for condonation of delay are moved. 2.

Heard learned counsel Shri J.B. Gandhi for the applicant.

For the reasons stated in both these applications, .....2/-

cao1732.18 53 the applications are allowed subject to payment of costs of Rs.500/- to be deposited with the High Court Bar Association at Nagpur within a period of 10 days from today. 4.

On costs being deposited, Civil Application No.188/2017 and FA St.No.9587/2016 shall stand restored. 5.
