ADMIT.

Advocate Shri N.H. Shams waives notice on behalf of the respondent no.1. Assistant Government Pleader Shri M.A. Kadu waives notice on behalf of the respondent nos.3 and 4. The appellant shall file private paper-book till 10.08.2015.

CIVIL APPLICATION F. NO.3501/2014 Considering the facts of the case, the amount deposited by the appellant be given to the respondent no.1 on filing undertaking before the Registrar (Judicial) of this Court to the effect that if at the time of hearing it is found that the

1802fa1075.14.odt respondent no.1 is not entitled for the amount withdrawn by her, the respondent no.1 shall deposit the amount with the Registry of this Court with interest as would be determined by this Court within stipulated time.

In view of the above order, the respondent no.1 shall not execute the impugned order.

The civil application is disposed of accordingly. JUDGE Wadkar
