By this application, the applicant is seeking condonation of delay caused in filing the application for leave to file appeal against judgment and order dated 19.03.2022 passed by the learned Judicial Magistrate First Class, Wani in S.C.C. No.974 of 2017, thereby acquitting the non-applicant under Section 138 of the Negotiable Instruments Act.

Learned counsel for the applicant submits that delay has been caused because the applicant was suffering from Covid-19.

In view of above and for the reasons set out in the application, the application is allowed. Delay of 30 days caused in filing the application for leave to file appeal against the judgment and order dated 19.03.2022 passed by the learned Judicial Magistrate First Class, Wani in S.C.C. No.974 of 2017, is condoned. Application for leave to file appeal be registered.
