Learned A.P.P. objected the petition on the ground that appeal against the impugned order is provided as per Section 60 of the Maharashtra Police Act and now the powers are with the Divisional Commissioner.

As we find that the alternate remedy is efficacious, we are not inclined to entertain the petition. The learned Advocate for the petitioner, on instructions, seeks permission to withdraw the petition with liberty to file appeal.

The petition is disposed as withdrawn with liberty as prayed for.
