This is an application for condonation of 21 days delay caused in filing the second appeal against the impugned judgment and decree dated 30.07.2022 passed by the District Judge-1, Gadchiroli.

Learned Advocate for the respondent has argued the application without filing the reply. He has submitted that the delay has not been properly explained and therefore, it may not be condoned.

I have gone through the application and the relevant record. On going through the application, I am
2 29.cas.175.2023 satisfied that the delay has been properly explained and on the basis of the same sufficient ground has been made out for condonation of delay. Accordingly, the application is allowed.

Delay of 21 days caused in filing the appeal stands condoned.

The second appeal be registered.

The application stands disposed of, accordingly. S ECOND APPEAL (ST. ) NO. 20152 OF 2022 8.
