This petition takes exception to the order dated 12th September, 2024 passed by the Family Court, Yavatmal below Exhibit 1 in H.M. Petition No.A/114/ 2024.

The respondent (husband) herein has filed a petition for divorce against the petitioner (wife) herein. 3.

By order dated 23rd August, 2024, the learned Family Court has allowed the application filed by the respondent for amendment of petition.

The petition was thereafter posted for carrying out consequential amendment to the written SKNair

925-wp-6415-24(j).odt statement, however, as the same was not carried out, by the order impugned the learned Family Court directed the petition to proceed without consequential amendment to the written statement.

Admittedly, the petitioner has not filed the application before the Family Court for recall of the impugned order and for grant of permission to carry out consequential amendment.

In that view of the matter, I am not inclined to entertain the present petition. However, considering the facts and circumstances, permission is granted to the petitioner to file an application for recall of the impugned order before the Family Court. If such application is filed, then the same shall be decided on it's own merits.

The writ petition is disposed of in the aforesaid terms.
