DATE : December 03, 2015 Petitioner herein has challenged a decree passed by the Family Court dated 09/01/2015 whereby the petition filed by respondent seeking divorce has been allowed.

Remedy of appeal under provisions of Section 19(1) of the Family Court's Act, 1984 is available to the petitioner. Though it is submitted on behalf of the petitioner that the respondent is likely to remarry, same cannot be a ground for entertaining the writ petition when a statutory remedy is available.

With liberty to the petitioner to file appeal under Section 19(1) of the said Act, the writ petition is not entertained and same is disposed of accordingly. JUDGE Asmita
