Petitioner - Agriculture Produce Market Committee points out that list of Secretaries prepared by respondent no.2 had already expired and though it made several attempts, the Secretary was not forwarded by respondent no.2.

Advocate Kalmegh states that as per his instructions after orders of this Court dated 10th of December, 2013 list of selected candidates was forwarded to petitioner and petitioner could have chosen the Secretary from it. Shri Ghate disputes this position.

However, the plea that list was not forwarded is not there in the application. Similarly, statement that list was forwarded and petitioner has not chosen candidate from it is not appearing in the reply. Hence, without observing anything in that
