The applicant is seeking pre-arrest bail under Section 438 of the Code of Criminal Procedure in Crime No.335 of 2022, registered with Police Station, City Kotwali, Akola for the offences punishable under Sections 188, 272, 273, 328 of the Indian Penal Code and Sections 26(1), 26(2)(i), 26(2)(iv), 30(2)(a) of the Food Safety and Standards Act, 2006.

The contraband has already been seized by the Police Authorities. Furthermore, there are no criminal antecedents to the discredit of the applicant. Nothing has been pointed out from the record to show that there is any possibility that the applicant may pressurize the prosecution witnesses or tamper the prosecution evidence or he will not be available for trial, I am of the opinion that the applicant is entitled for grant of pre-arrest bail. Accordingly, I pass the following order:

2 20-ABA855-22 i) Criminal application is allowed;

ii) The order dated 07/12/2022, granting adinterim anticipatory bail to the applicant is hereby confirmed.

ii) The applicant shall attend the concerned Police Station as and when his presence is required.

iii) The applicant shall not tamper with the prosecution evidence.

The Criminal Application is disposed of accordingly.
