DATE : November 22, 2017 The applicant who has been arrested on in connection with Crime No.410/2017 registered with Police Station Pusad City, Dist. Yavatmal for the offence punishable under Sections 292, 293, 354-D, 501, 507 of the Indian Penal Code, Sections 66, 66-B, 66-C of Information Technology Act, 2000 and Section 11(4) and 12 of Protection of Children from Sexual Offences Act, seeks his release on bail.
As per the First Information Report dated 12/09/2017 the informant has stated that she was familiar with the applicant since the year 2016. The informant and the applicant were attending tuition classes together and in that process they developed friendship. The applicant used to contact the informant on mobile phone. After the parents of the informant got information about their activity, the informant as well as the applicant were told to discontinue their friendship. Despite that they both continued to keep in touch with each other. It is alleged that on the facebook
2/3 account of the informant certain messages were posted at the behest of the applicant. Hence the offence came to be registered.
It is submitted on behalf of the applicant that the applicant is a student and on account of his friendship with the informant, he used to have contact with her. There is no illintention on his part. As the investigation is now almost complete and considering the nature of allegations, he deserves to be released on bail as he is a student. The application is opposed by the learned Additional Public Prosecutor by filing reply. It is submitted that the nature of allegations indicate role of the applicant and it is clear that he is guilty of posting the messages in question. Perused the First Information Report as well as the reply. Considering the fact that after arrest of the applicant on 12/09/2017 all incriminating material has been seized, he deserves to be released on bail. He being a student his presence behind bars would serve no purpose.
Accordingly the applicant Sachin Rameshwar Dhok who has been arrested in connection with Crime No.410/2017 registered with Police Station Pusad City, Dist. Yavatmal for the offence punishable under Sections 292, 293, 354-D, 501, 507 of the Indian Penal Code, Sections 66, 66-B, 66-C of Information Technology Act, 2000 and Section 11(4) and 12 of Protection of Children from Sexual Offences Act, is directed to
3/3 be released on bail on furnishing PR Bond of Rs.20,000/- (Rupees Twenty Thousand) with one surety in the like amount.
The applicant shall co-operate in completion of the trial. He shall not take any steps to contact the informant and influence the prosecution witnesses.
The observations made in this order are only for deciding this application which is allowed and disposed of. JUDGE Asmita
