It is common ground that the parties have settled their dispute in mediation and agreement to that effect came to be executed before the learned Mediator. The appellant and respondent No.2 are physically present whereas, responded No.1 appeared through video conferencing. They are duly identified by the counsels. They admit the execution of agreement and the terms contained therein.

In wake of above, the appeal is partly allowed in terms of the settlement of agreement dated 17.02.2025. The decree be drawn in terms of the settlement agreement.
