This is an application seeking transfer of Petition No.A-89 of 2024 filed by the non-applicant under Section 13(1)(ia) of the Hindu Marriage Act, 1955 before the Family Court, Bhandara to the learned Civil Judge Senior Division, Warora. 3.

It is contended that there is no direct train or bus to travel from Warora to Bhandara District. It is also contended that domestic violence proceedings are pending before the Court of Judicial Magistrate First Class, Warora and the non-applicanthusband is attending the said case. The learned counsel for the applicant brought my attention to the order of this Court whereby, the earlier divorce petition filed by the non-applicant before the learned Civil Judge Senior Division, Bhandara was directed to be transferred to the learned Civil Judge Senior Division, Warora. It is further contended that the non-applicant-husband has withdrawn the said petition and has filed a fresh divorce petition at Bhandara.

Though, the non-applicant-husband is served but he chose not to appear in the matter. Therefore, the contention remains uncontroverted.

In view of the above, a case is made out for transfer of Petition No.A-89 of 2024 pending before the Family Court, Bhandara to the Court of the learned Civil Judge Senior Division, Warora.

Let the proceedings bearing Petition No.A-89 of 2024 pending before the Family Court at Bhandara be transferred to the Court of the learned Civil Judge Senior Division, Warora. 7.

Accordingly, the application stands disposed of. JUDGE Tambe.
