The Family Court, Nagpur has vide interim order dated 10-6-2022 directed the petitioner - husband to pay monthly maintenance of Rs. 1500/- for respondent - wife and Rs. 1000/- for their daughter.

The order is challenged on the count that the petitioner is handicapped and is earning Rs. 2,000/- per month only and, therefore, may not be able to comply the order. The law on the point is well settled. The husband is duty bound to pay reasonable amount as monthly maintenance to his wife and daughter. Rs. 2500/- is an amount which is least that the petitioner should pay for the subsistence to have daily needs of the respondent's and their daughter satisfied. This is not a case where the wife should be called here to answer the petitioner's grievance. The petition is, therefore, dismissed in limini. 4.

The fees of Advocate appointed for the petitioner be paid as per the rules.
