DATED : FEBRUARY 8, 2021 Mr. Dixit, learned counsel for petitioner is absent. Mr. Bade, learned counsel for respondent is present. By this writ petition, petitioner is challenging order dated 03.05.2014 below Exh.-13 in Regular Civil Suit No.6/2014 passed by learned Civil Judge Junior Division, Gondia, whereby learned Judge of the Court below allowed the application filed on behalf of present respondent under Section 10 of the Code of Civil Procedure and stayed the regular Civil Suit No.6/2014 till conclusion of evidence in Regular Criminal Case No.553/2013. Mr. Bade, learned counsel for respondent who moved the application under Section 10, submits that Regular Criminal Case No.553/2013 is already decided resulting into acquittal of the accused therein. He, therefore, submits that the present writ petition has rendered infructuous. The civil suit was stayed till conclusion of Regular Criminal Case No.533/2013, which is now decided by learned Magistrate as per the statement made by Mr. Bade, learned counsel for the respondent.

The statement is accepted.

In that view of the matter, nothing survives in this writ petition. The writ petition is disposed of accordingly. JUDGE kahale
