Admittedly caste claim of petitioner as belonging to 'Halba Scheduled Tribe' is still receiving consideration and is pending with the respondent no.1 Scrutiny Committee.
Order 2301wp1271.14 Petitioner has joined employment on 19.02.1997. This Court has protected his employment while issuing notice on 10.06.2014.
In this situation, we direct the petitioner to appear before the respondent no.1 Scrutiny Committee on 09.03.2015, and abide by its further instructions in the matter. The Committee shall attempt to verify the tribe claim of the petitioner in accordance with the Maharashtra Scheduled Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000, within a period of one year. Till the Scrutiny Committee passes further appropriate orders in the matter, the interim orders granted by this Court on 10.06.2014 shall continue to operate and the same shall be subject to said order. Writ Petition is, thus, partly allowed and disposed of. No costs.
