The petitioner challenging the order passed by the learned Industrial Court in Complaint ULP No.90/2020. By this judgment, the directions given to the petitioners herein to take a decision on the Early Retirement Scheme Application of the complainant dated 20.06.2017 and the subsequent corrections, within three months from the passing of the order. As there was no decision taken, the complainant has filed the Contempt proceeding.

In my considered opinion, in fact, there is no reason to challenge this order and petitioners would have taken the decision either way on the application of the complainant. However, considering other litigations pending before the Industrial Court, it would be appropriate to extend that period for

2 34 wp 6479-2024 decision on application for Early Retirement Scheme till 05.04.2025.

The petitioners to take decision by 05.04.2025.

The Writ Petition is dismissed in above terms. JUDGE R.S. Sahare
