DATE : JUNE 19, 2015 Shri V. D. Raut, learned counsel appearing for the petitioner submits that during pendency of the present writ petition, complaint U.L.P. No.39 of 2009 had been dismissed on 22/01/2015 and said order has been challenged by preferring a separate revision application. As the present proceedings arise out of an interlocutory application that was filed during pendency of complaint No.39 of 2009, the challenge in the present writ petition is therefore rendered infructuous. It is however clarified that the adjudication in the complaint vide order dated 22/01/2015 shall not preclude the petitioner from prosecuting the application filed under Payment of Wages Act, 1936 and the same shall be decided in accordance with law.

Writ petition is disposed of as infructuous.
