DATE : 09.01.2018 By this criminal writ petition, the petitioners seek a direction against the respondent nos.1 and 2 to take urgent steps to appoint the competent authority under Section 5 and Rule 3 of the Maharashtra Protection of Interest Depositors (In Financial Establishments) Act, 1999 and the Rules framed thereunder. A direction is also sought against the Special Court to expedite the matter and attach, seize and sell the properties of the respondent no.3 - Company.

The learned Additional Public Prosecutor appearing for the respondent nos.1 and 2 states that the grievance of the petitioners should stand redressed, inasmuch as the competent authority under the Act of 1999 is constituted and certain properties of the respondent no.3 - Company are attached and some of them are also auctioned.

0901wp875.16.odt In view of the statement made by the learned Additional Public Prosecutor, the grievance of the petitioners would not survive. Hence, we dispose of the criminal writ petition. Order accordingly.
