Heard learned counsel for the applicant and learned counsel for respondent.

Applicant-wife has filed HMP No.
A-935/13 before the Family Court at Nagpur for judicial separation while respondent-husband has filed HMP No. 110 of 2013 for restitution of conjugal rights in the court of Civil Judge, Senior Division, Gondia. 3.
Learned counsel for applicant contends that applicant-wife is finding it very difficult to attend the proceedings at Gondia and, therefore, proceedings pending at Gondia be transferred to Nagpur. Learned counsel for respondent-husband has not seriously opposed the application.

For the reasons stated in the application, the same deserves to be allowed. Moreover, in case of transfer, no prejudice would be caused to respondenthusband since he is residing at Dombivali, District Thane.

In the result, application is allowed. HMP No. 110 of 2013 filed by respondent stands transferred from the file of Civil Judge, Senior Division, Gondia to the file of Judge, Family Court, Nagpur and shall be tagged with HMP No. A-935 of 2013 filed by applicant. Both the petitions shall be decided expeditiously. No order as to costs.
