Apprehending arrest in connection with Crime No.91/2018 registered by the non-applicant for the offence punishable under Sections 65(e) and 83 of the Maharashtra Prohibition Act, the applicant seeks pre-arrest bail.

The accusations against the applicant are that huge stock of country liquor worth Rs.2,50,000/- is seized from the field owned by Shri Moreshwar Borkar and which was taken for cultivation on contract by the applicant, the field being situated at Nandgaon, Tah. Mul, Distt. Chandrapur where sale of liquor is prohibited. The applicant claims that any other crime / offence is not registered against him. The non-applicant has not controverted this fact.

Considering the nature of accusations against

2 aba690.18 the applicant and the fact that the non-applicant has not been able to point out that custodial interrogation of applicant is necessary, the order passed by this Court on 1st October, 2018 is confirmed. The application is allowed accordingly.
