In the present petition, the facts pleaded by the petitioner is disputed by the State. More so, the petitioner has alternate remedy of appeal. The learned counsel for the petitioner seeks withdrawal of the petition with liberty to file appropriate proceedings before the appropriate Authority.

The petition is dismissed as withdrawn with above said liberty.

The time in pursuing the proceedings may be considered by the Appellate Authority, while entertaining the appeal.
