Heard learned counsel for the applicant and learned APP for the State. I have gone through the order dated 05.09.2023.

Learned counsel for the applicant submitted that in order dated 05.09.2023 it is mentioned in para 4 of the order that brother of the applicant is still not arrested. According to her, he had surrendered before the learned Judicial Magistrate First Class on 19.04.2023. To that extent the order dated 05.09.2023 requires the correction. 3.
Learned counsel for applicant took me through the reply filed by the State in the application. Perusal of reply goes to show that the police inspector, in his reply, mentioned that Ranjan Bawankar had surrendered on 19.04.2023. Learned counsel for the applicant submits that Ranjan Bawankar is the brother of the applicant, who has been mentioned in the order.

In view of reply filed by the police inspector of Goregaon Police Station, District Gondia, the statement in the said order requires to be corrected. In para 4, the words "who is still not arrested." be replaced by "who had surrendered before the learned JMFC on 19.04.2023." 6.
Correction be carried out and corrected order be uploaded accordingly. The application stands disposed of. JUDGE Wagh
