DATE : 12 th FEBRUARY, 2020 01] We have heard the learned Advocate for the petitioner and the learned A.G.P. on behalf of the respondent-Committee. We have perused the order passed by this Court, dated 04/02/2016, in which this Court had directed under paragraph 5 as under : "5. Accordingly, the order dated 24/07/2000 passed by the Scrutiny Committee is quashed and set aside. The Scrutiny Committee shall conduct fresh proceedings in the matter of grant of validity to the petitioner by following the provisions of Act No.XXIII of 2001.

The petitioner shall appear before the Scrutiny Committee on 22/02/2016 and the Scrutiny Committee shall decide the caste claim within a period of 12 months from said date. Writ Petition is allowed in aforesaid terms with no order as to costs."

cp.21.20 2/2 02] When called upon to state, the learned Advocate for the petitioner frankly admits that he has not appeared before the Scrutiny Committee on 22/02/2016 as was directed by this Court. He has subsequently moved a representation on 15/06/2016 and the matter has been lingering since then. 03] The learned A.G.P. submits that the claim of the petitioner was earlier before the Nagpur Committee and was subsequently transferred to the Committee at Amravati. The Committee would decide the proposal within 60 days from today.

04] In view of the said statement and considering the fact as recorded above, this petition is disposed off with the following directions :- I.

The petitioner shall appear before the respondent-Committee at Amravati on 24th February, 2020 at 03:00 p.m. and shall thereafter abide by the dates on which the proceedings are posted by the Committee.

II.

If the petitioner remains absent on any date, the Committee shall proceed to decide the caste claim of the petitioner without his assistance.

III.

Upon the compliance of the above directions, the Committee shall decide the claim of the petitioner on its own merits, on or before 24th April, 2020 and there shall be no further extension of time.
