The learned counsel appearing for the petitioners upon considering Section 10 of the Code of Civil Procedure, 1908 and its true purport, seeks to withdraw the present writ petition with liberty to move the appropriate Court i.e. the Court of Civil Judge, Senior Division, Wardha, in order to prefer appropriate application under the aforesaid provision.

Hence, writ petition is disposed of as withdrawn with the aforesaid liberty.
