The prayer Clause-1 shows that, the petitioner is seeking a direction to the Municipal Council, Achalpur and respondent No.2 Headmaster of Nagar Parishad Primary School, Chandur Bazar to resume on the post of Assistant Teacher at Municipal Girls School, Durani Chowk, Paratwada, District Amravati.

It is the case of the petitioner that, the respondent No.2 is not allowing to join the duty as Assistant Teacher, thus, it is evident that, this matter relates to otherwise termination.

There is no prayer made in the present writ petition for quashing of such otherwise termination. In that view of the matter, we are of the view that, the present writ petition is not maintainable.

At this stage, the learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to file appropriate proceeding before the appropriate forum as permissible under the law. 5.

Accordingly, the writ petition is disposed of as withdrawn with liberty as prayed for.
