This application is for condonation of 351 days' delay caused in preferring appeal against judgment and order dated 28/9/2016 passed by learned Additional Sessions Judge, Achalpur in Sessions Trial No. 67/2015 by which applicant came to be convicted for the offence punishable under Section 304 Part II of Indian Penal Code and sentenced to suffer rigorous imprisonment for seven years and to pay fine of Rs.5000/- and in default, to suffer simple imprisonment for six months. For the grounds mentioned in the application, delay caused is found satisfactorily explained and hence, same is condoned. The criminal application is allowed accordingly.
