By this application under Section 439 of the Code of Criminal Procedure the applicants are seeking bail in Crime No.529 of 2022, registered with Police Station, Balapur, District: Akola for the offences punishable under Sections 304(B), 498-A, 504, 506 read with Section 34 of the Indian Penal Code.

After hearing for some time and on expressing that the Court is not inclined to grant bail to the applicant No.1, on instructions, the learned counsel for the applicants seeks permission to withdraw the application qua the applicant No.1-Anand Dadarao Wankhade. 4.

As far as applicant No.2 is concerned, after going through the F.I.R. no specific allegations against the applicant No.2 are found. Prima-facie, it appears that the general allegations are made.

The applicant No.2 is in jail from about 45 days and considering that there are no specific allegations against the applicant, I am of the opinion that though the learned A.P.P. is opposing the present application, the applicant No.2 is entitled for grant of bail. Accordingly, I pass the following order:

i) Criminal Application qua the applicant No.1-Anand Dadarao Wankhade is disposed of as withdrawn.

ii) Criminal Application qua the applicant No.2-Shuddhodhan @ Bandu S/o. Dadarao Wahkhade is allowed.

iii) It is directed that the applicant No.2Shuddhodhan @ Bandu S/o. Dadarao Wahkhade shall be released on bail in connection with Crime No.529 of 2022, registered with Police Station, Balapur, District : Akola for the offences punishable under Sections 304(B), 498-A, 504, 506 read with Section 34 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Fifty Thousand with one solvent surety in the like amount;

3 38-BA1415-2022 iv) The applicant No.2 shall attend the concerned Police Station as and when his presence is required, till culmination of the trial.

v) The applicant No.2 shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence;

vi) The applicant No.2 shall attend the trial before the Sessions Court regularly on every date unless exemption is granted by the Sessions Court.

The Criminal Application is disposed of accordingly.
