This is an application for condonation of 77 days delay caused in preferring application under Section 378(3) of the Code of Criminal Procedure, 1973.

Learned A.P.P. submits that the aforesaid delay is caused only due to administrative compliances, it being a State appeal.

Per contra, learned counsel for the respondent strongly opposed the instant application. For the reasons recorded in paragraph Nos. 2 and 3 of the instant application and finding them to be satisfactorily explained, the same is allowed. Delay of 77 days caused in preferring application under Section 378(3) of the Cr.P.C., is condoned.
