The appellant - Insurer is seeking for condonation of delay of 3 days in filing first appeal. It is not disputed that the delay was on account of formality to be complied by the Office and it was unintentional. Considering the law in this regard of taking liberal approach, I deem it fit to condone the delay even without issuing notice to the respondents. Hence, delay stands condoned.

The appellant is seeking stay to the execution of impugned award passed in Claim Petition No. 128/2014.

The learned counsel for appellant made a statement that he would deposit entire compensation amount within period of 8 weeks. In that view, execution of impugned award is stayed for 8 weeks.

Issue notice to the respondents returnable after 8 weeks.
