The petitioner has challenged the order dated 04.11.2015 issued under section 14(2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. On 09.12.2015 on the statement made by the learned counsel for the petitioners that though the one time settlement offer had been accepted by the respondent no. 1-Bank the impugned order came to be passed, notice for final disposal of the writ petition came to be issued. It was further recorded that the matter was placed before the Lok Adalat on 12.12.2015. On 17.12.2015 the writ petition was adjourned on the ground that the
2701wp6588.15 offer could not be accepted as one of the Directors of the petitioner Company was at Pune. Adjournment was again granted on 14.01.2016 and 21.01.2016.
Shri S. D. Khati, learned counsel for the petitioners submits that the petitioner would approach the Debts Recovery Tribunal for challenging the order dated 04.11.2015. On the statement of the learned counsel, the writ petition is permitted to be withdrawn. Points raised in the petition are kept open. The ad interim relief granted on 09.12.2015 stands vacated.
