DATED : NOVEMBER 06, 2019 Mr. Rai, learned counsel for the applicant submits that investigating agency has filed charge-sheet and the application for bail was not considered by the learned Judge of the Court below in the light of the charge-sheet. He, therefore, wishes to withdraw the present application with liberty to file an application for bail afresh before the Court below.

The application is disposed of as withdrawn with a liberty to file an application afresh before the Court below in view of the changed circumstance i.e. filing of the charge-sheet. The learned Judge of the Court below shall decide the said application on its own merit in accordance with law.

It is made clear that this Court has not heard the case of the present applicant on its own merit. JUDGE srwagh
