Admit on following substantial question of law : " Whether paragraph 262 in the principles of Hindu Law by Mulla would continue to operate in the face of provisions of Section 4 of the Hindu Succession Act, 1956 ?" Shri S. T. Moon, the learned counsel waives notice for respondent No.3 (ii) to (vi).
C.A. No.1330 of 2014 Notice on this application was issued on 19/12/2014 and by way of ad interim order, the parties were directed to maintain status quo as it was the case of the applicant that he was in possession of the suit property.
There is no reply filed on behalf of the contesting nonapplicants. Hence accepting the averments made in the application, there shall be interim injunction in terms of prayer clause (i). Civil application is disposed of.
