Criminal Application(BA) No.357 of 2017 filed by the applicant earlier was dismissed as withdrawn on 20th June, 2017. Now, this application is again moved mainly on the ground that the trial has not commenced and the applicant is in jail for last three years.

The non-applicant has filed additional affidavit pointing out that delay in commencement of trial is because of the non-co-operation of the accused.

I do not find any change in the circumstances in view of which the present application is required to be considered.

The application is dismissed. The applicant will be at liberty to request the Sessions Court for expediting the trial.
