Heard Shri Charlewar, learned counsel for the applicant/ appellant as also Shri Anthony, learned counsel for the non-applicants.
The prayer is to recall Court order dated 30.09.2014. The submission is, entire amount as directed by this Court was deposited. Earlier, it was stated that the period to be looked into is from 01.08.2008 till 17.07.2012. The learned counsel for the applicant submitted that the amount for the said period works out to Rs.12 lakh. According to the respondent - wife, it works out to Rs.14,10,000/-.
The applicant could not give definite amount due and payable during this period. However, the learned counsel chose to argue further presuming the figure of Rs.14,10,000/- to be correct. The payments made subsequent to this Court order dated 17.07.2012 is sought to be included for said purpose.
The question, therefore, arises about the actual amount which falls due for the period from
271cao1567.14 01.08.2008 till 30.09.2014 i.e. the date on which this Court vacated stay. The stand of present applicant finds mention in order dated 30.09.2014 also. Again that amount is not quantified and has not been disclosed. We find that in this situation, no case is made out for recall of order. Application is rejected. JUDGE JUDGE *GS.
