IN THE HIGH COURT OF JUDICATURE AT BOMBAY

Wankhede, Advocate for the petitioner CORAM : Z.A.HAQ, J.

DATED : 09/01/2019 Heard.

The petitioner - Corporation (employer) has challenged the interlocutory order passed by the Industrial Court under Section 30 (2) of the Maharashtra Recognition of Trade Unions And Prevention of Unfair Labour Practices Act, 1971. By the impugned order, the Industrial Court has stayed the effect and operation of the order seeking to transfer the respondent from Imamwada Depot at Nagpur to Wardha Division.

After going through the impugned order, I find that the Industrial Court has exhaustively dealt with the relevant facts and the submissions made by the parties before it. The petitioner has not been able to point out any perversity or illegality in the impugned order. The Industrial Court has the jurisdiction to pass such interim order while exercising jurisdiction under Section 30 (2) of the Act of 1971.

2 wp65.19 I see no reason to interfere with the impugned order.

The writ petition is dismissed. No costs.
