The applicant is arrested on 1st August, 2018 in connection with Crime No.191/2018 registered by the non-applicant against eight accused (including the applicant) for the offence punishable under Sections 307, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and Section 4 and 25 of the Arms Act. Criminal Application (BA) No.893/2018 filed by co-accused Sonu Sapkal is rejected today itself.
The present application is also opposed by the investigating agency on the same grounds as recorded in the order passed in Criminal Application (BA) No.893/2018, however, considering the fact that the accusations against the applicant are that he was armed with a stick and further taking note of relevant fact that applicant is a student of 3rd year B.Sc. Computer Science and accepting the submission made on behalf of the
2 ba894.18 applicant that he is not involved in any other crime / offence, following order is passed:
(i) The applicant having been arrested in connection with Crime No.191/2018 registered by the non-applicant, he be released on bail on executing P.R. bond for Rs.20,000/- (Rs. Twenty Thousand) and furnishing two solvent sureties in the like amount. (ii) Out of two solvent sureties, one shall be by either father or mother of the applicant.
(iii) The applicant shall submit his passport to the investigating agency.
(iv) If the applicant is not having a passport in his name, he shall submit an affidavit to that effect to the investigating agency.
(v) The application is allowed in the above terms. JUDGE Tambaskar.
