DATE : 03rd November, 2017 It is submitted on behalf of the applicants that application filed by them under Section 438, Criminal Procedure Code, is pending before the Sessions Court. As notice was issued on that application and protection was not granted, the present application came to be filed.

The learned counsel for the applicants on instructions seeks permission to withdraw the present application with liberty to prosecute application before Sessions Court.

The application is permitted to be withdrawn with aforesaid liberty. Ad interim order granted on 17th October, 2017 shall continue to operate for a period of one week from today.

It is clarified that the Sessions Court shall not be influenced by grant of this ad interim order and it shall decide the application on its own merits.
