Perused contents of the application as well as the reasons given for the cause of delay. As the same are found to be sufficient, the delay in filing the restoration application stands condoned.

Civil application is allowed and disposed of. M.C.A. ST. NO.13535/2018.

As the parties submitted that the dispute has been amicably settled, the Second Appeal is restored to file. Miscellaneous Civil Application is allowed and disposed of..

C.A.O. NO.1799/2018 AND S.A. NO.465/2008.

By this application, it is jointly prayed by the parties that the second appeal be disposed of in terms of the joint pursis filed by them.

As per that joint pursis, the respondents have received an amount of Rupees Three Lakhs from the appellants vide Demand Draft dated 25.09.2018. It is stated that this acceptance is towards full and final settlement of their claims against the appellants. The pursis is signed by the parties and their respective counsel.

CAO1083-18 In view of aforesaid, the prayer made in the civil application is granted. Second Appeal No.465 of 2008 is accordingly disposed of in terms of the joint pursis filed alongwith Civil Application No.1799 of 2018. The parties shall act accordingly. In the facts of the case, there would be no order as to costs.
