CORAM
: ANIL L. PANSARE & M.M. NERLIKAR, JJ.
DATE : 8 th AUGUST, 2025.
The petitioner has approached this Court with the following substantive prayer (1) of the petition:
1. Pass the writ of Mandamus and/or other suitable order and direction appropriate and thereby quash and set aside the attachment order 1/34 of 2018 registered with CERSAI (Annexure P3) on 21/07/2023 and attachment order No. NAG/ VAT/E-011, Nagpur/B-584, dated 09/12/2022 mutated on 14/01/2023 with City Survey Office-III, Nagpur by Deputy Comm. MSGST E-011, Nagpur."
02.
As could be seen, the petitioner is seeking to quash order of attachment No.1/34 of 2018, dated 21/07/2023 (Annexure P3). 03.
We have gone through Annexure P3. We find that it is a challan issued by the Sub-Registrar Office in respect of sale-deed executed between one Ramkrishna Govind Poddar and the petitioner. 04.
At this stage, the learned Counsel for the petitioner submits that, what the Court is reading, is not Annexure P3, but is Annexure P4. However, it appears that while scanning the documents, Annexure P4 has been marked as Annexure P3 and, therefore, we have noted the aforesaid fact.
925.wp.6925.24 2/2 05.
The Registrar (Judicial) shall enquire into the matter and take appropriate action against the erring officials. 06.
Coming back to the merits of the matter, Annexure P3 appears to be 'Asset Based Search Report', which is known to the petitioner to be not an attachment order.
07.
The learned Counsel for the petitioner submits that the attachment order is not available with him. If that be so, the Court cannot find fault in the order as it is not available for perusal as well. 08.
The petition is accordingly dismissed. The petitioner may obtain the order and file a petition afresh.
