The private parties state that the property dispute is amicably settled between them.
Our attention is invited to copy of plaint on record and order passed by the Trial Court mentioning that it has seen and recorded compromise. The certified copy of order, passed below Exh.1, in Special Civil Suit No.915 of 2014, filed by non-applicant No.2 for specific .....2/-
performance, is also produced before us.
Non-applicant No.2 as also applicant No.1 are identified by their counsel and they accept the compromise.
In this situation, as we find that the dispute has arisen out a private controversy, in relation to property transaction, we make the Rule absolute in terms of prayer clause (a) of the criminal application. Certified copy of order, below Exh.1, in Special Civil Suit No.915 of 2014 produced by learned counsel Shri A.R. Prasad for non-applicant No.2, is taken on record as "Exhibit A".
Accordingly, the criminal application is disposed of.
