Learned APP submits that now the case is fixed for recording the evidence of the prosecution witnesses before the trial Court. It appears that the required steps are not taken by the learned Judge to ensure the presence of witnesses. Learned Judge shall see that trial is conducted consistent with the mandate of Section 309 of the Code of Criminal Procedure.

Learned Advocate for the applicant seeks leave to withdraw the application with liberty to make an application for bail after three months if there is no substantial progress in the trial. The criminal application stands disposed of, as withdrawn.

Considering the volume of the evidence, liberty is granted to make fresh bail application if there is no substantial progress in the trial within four months. The learned Judge shall see that the matter is disposed of expeditiously.
