The applicant has filed this application for release him on temporary bail.

The applicant is arrested in connection with Crime No.105/2023 registered at Police Station Shegaon, District Buldhana for the offences punishable under Sections 406, 409, 420, 120-B, 506 and 507 of the Indian Penal Code.

Earlier, the applicant was released on temporary bail for bypass surgery. He was on temporary bail for eight weeks. However, the surgery was not conducted because of his health issue. His sugar was high and, therefore, during that period, the surgery was not conducted.

The learned Counsel for the applicant has stated that now, the doctors have suggested him to undergo bypass surgery. It will require eight months time to recover, therefore, prayed to release the applicant on bail for eight weeks.

The learned A.P.P. has filed on record the opinion given by the Medical Officer. According to Medical

2 36.ba.1086.25 Report, the surgery is required, but for recovery of surgery, six to eight weeks period is sufficient.

After going through the papers and as the applicant requires to undergo bypass surgery, the applicant is temporarily released on bail for eight weeks. Accordingly, I proceed to pass the following order : i] The criminal application is allowed.

ii] The applicant shall be released on interim bail in connection with Crime No.105/2023 registered at Police Station Shegaon, District Buldhana for the offences punishable under Sections 406, 409, 420, 120-B, 506 and 507 of the Indian Penal Code to undergo the bypass surgery for a period of eight weeks on condition that :

iii] The applicant shall not in any way tamper with the prosecution evidence.

iv] The applicant shall not pressurize or threaten the prosecution witnesses.

v] After undergoing the bypass surgery, if the applicant's health permits, attend the trial. vi] The applicant shall co-operate with the Investigation Officer.

vii] After eight weeks the applicant shall surrender before the Superintendent of District Prison, Buldhana. On failure to appear before

3 36.ba.1086.25 the Superintendent of District Prison, Buldhana, the investigating agency to take appropriate steps to obtain the arrest and produce him before the appropriate Court.

The Criminal application is disposed of accordingly.
