Heard Shri N.S. Khandewale, learned counsel for the applicants, Shri A.S. Ashirgade, learned A.P.P. for non-applicant no.1 and Shri A. Sambre, learned counsel for non-applicant no.2.

Scuffle between applicants and group of non-applicant no.2 in night between 6th and 7th November, 2015 is not in dispute. Only question is, whether it occurred within the premises of property of non-applicant no.2 or outside it, and who is at fault ? 3.

Both sides have filed reports against each other. Facts show that report lodged by the applicants

Order 1704apl871.15 is earlier in point of time.

Learned A.P.P. points out that investigation is over and charge sheet is already presented against the applicants before the Competent Court.

Learned counsel for applicants points out that no investigation has been carried out in the matter of report lodged by the present applicants.

After hearing the learned counsel and taking over all view of the matter, at this stage we are not inclined to delve more into the matter. Charge sheet is already presented and rival contentions can be looked into by the trial Court. It is also open to the applicants to place their grievance before that Court in accordance with law.

All disputed questions can be looked into by that Court during trial. Hence, without observing any thing more and with liberty to the applicants to take such other steps as are available to them in law in the matter, we dispose of the present proceedings. No costs.
