Apprehending arrest in connection with Crime No. 364/2018 registered by the non-applicant for the offences punishable under Section 65 (a) of the Maharashtra Prohibition Act r/w Section 188 of the Indian Penal Code and Section 130/177 of the Motor Vehicles Act, the applicant seeks pre-arrest bail.

According to the Investigating Agency, the applicant/accused was carrying country liquor in his four wheeler and when signal was given to stop the vehicle, he had not stopped and attempted to drive away and in the process the vehicle dashed with the iron barricade. According to the Investigating Agency, after the vehicle dashed, the applicant had run away. The accusations are that the applicant was transporting the country liquor to Chandrapur District where sale of liquor is prohibited.

2 aba700.18 The application is opposed on the ground that further investigation is in progress and the Investigating Agency has to find out other persons involved in the illegal trade.

Considering the nature of accusations against the applicant, I am not inclined to grant the prayer made in the application.

The application is dismissed.
