OCTOBER 8, 2025 The prayer is to investigate Crime No.94/2024, registered at Nandanwan Police Station through respondent No.4 - Directorate of Enforcement and not by respondent No.3 - Economic Offences Wing, Nagpur.

Counsel for respondent Nos.1 to 4 submits that the cognizance of the offence has been already taken by respondent No.4 in ECIR bearing No. ECIR/KLZO-II/21/2022, on the basis of the FIR registered vide Crime Nos.290/2022 and 297/2022. According to him, the ECIR is recorded on the basis of same facts as mentioned in the instant petition.

If that be so, respondent No.3 should have taken note of the same and proceeded further in the matter of investigation in Crime No.94/2024. Unfortunately, respondent No.3 has completed the investigation and filed charge-sheet before Sessions Court, Nagpur bearing No.116/2024.

In that view of the matter, so far as the petitioner is concerned, his grievance does not survive. In other words, the prayer as sought to transfer the investigation does not survive because charge-sheet has been filed. Petitioners may approach Trial Court for further investigation.

The petition is accordingly disposed of.
